A evolução dos meios de comunicação propiciou um massivo fluxo informacional, trazendo consigo alguns entraves. O fenômeno das fake news é produto dessa mudança na sociedade, afetando de diversas formas a vida das pessoas e inclusive a possibilidade de uma escolha plena e livre de influências, sua liberdade de expressão, pensamento e informação. Nesse contexto, este evento se torna gravoso para o nosso Estado Democrático, na medida que influencia o comportamento, as escolhas políticas, a conduta social e a solidez da (...) própria democracia. Diante do exposto, o objetivo do presente trabalho é refletir como as fake news interferem no Estado Democrático de Direito no Brasil e o deformam. Trata-se de uma revisão bibliográfica, documental e qualitativa. Propõe-se, por meio desse estudo, explicitar o que é esse fenômeno tão complexo das fake news e compreender as diversas formas de como ele pode afetar nosso sistema democrático, baseando-se nas ideias discursivas de Habermas. O presente artigo tem por finalidade avaliar o problema intuicionista com as provas não construtivas na matemática. Para esta posição construtivista o princípio do terceiro excluído, da lógica clássica, não deve operar sobre demonstrações matemáticas. As provas não construtivas não são aceitas, sendo as provas construtivas as únicas com caráter positivo. Após uma breve introdução ao intuicionismo e seu idealizador, o artigo abordará a relação entre o princípio do terceiro excluído e as provas na matemática, para assim falar sobre o (...) problema das provas não construtivas e da consequência em não aceitá-las. Ao tomar a matemática unicamente como um empreendimento de construção mental, o intuicionismo quebra com o realismo platônico dominante e estabelece um debate frutífero sobre os fundamentos da matemática. For the epic journey of autumn migration, long-distance migratory birds use innate and learned information and follow strict schedules imposed by genetic and epigenetic mechanisms, the details of which remain largely unknown. In addition, bird migration requires integrated action of different multisensory systems for learning and memory, and the hippocampus appears to be the integration center for this task. In previous studies we found that contrasting long-distance migratory flights differentially affected the morphological complexity of two types of hippocampus astrocytes. Recently, (...) a significant association was found between the latitude of the reproductive site and the size of the ADCYAP1 allele in long distance migratory birds. We tested for correlations between astrocyte morphological complexity, migratory distances, and size of the ADCYAP1 allele in three long-distance migrant species of shorebird and one non-migrant. Significant differences among species were found in the number and morphological complexity of the astrocytes, as well as in the size of the microsatellites of the ADCYAP1 gene. We found significant associations between the size of the ADCYAP1 microsatellites, the migratory distances, and the degree of morphological complexity of the astrocytes. We suggest that associations between astrocyte number and morphological complexity, ADCYAP1 microsatellite size, and migratory behavior may be part of the adaptive response to the migratory process of shorebirds. Este trabajo investiga las interrelaciones entre la regulación y los as-pectos económicos y ambientales en una comunidad de agricultores familiares en la región conocida como Zona da Mata Mineira, en el estado brasileño de Minas Gerais. El estudio es producto de una acti-vidad de extensión realizada entre 2016 y 2018, y tuvo como objetivo asesorar a los pequeños productores en el proceso de adecuación legal de la producción. Durante este período se realizaron cerca de cinco reuniones entre investigadores y comuneros, (...) en las que se analizaron las dificultades encontradas por los pequeños productores en relación con el referido proceso. Las experiencias reportadas fueron confron-tadas con el régimen legal regulatorio para la actividad acuícola en Brasil, tomando como categorías de análisis los atributos de norma-tividad y facticidad del sistema legal. Se concluyó que la regulación ambiental en el área de la acuicultura en Brasil, diseñada para grandes productores, carga de manera desproporcionada a los pequeños pro-ductores, generando un desequilibrio económico injustificado. Como aporte a la teoría, se propone, en definitiva, la formulación de un con-cepto de regulación jurídica inclusiva, cuyos rasgos distintivos inclu-yen la participación social y la promoción de la alfabetización jurídica como derecho fundamental. Although shared decision-making is a standard in medical care, unilateral decisions through process-based conflict resolution policies have been defended in certain cases. In patients who do not stand to receive proportional clinical benefits, the harms involved in interventions such as cardiopulmonary resuscitation seem to run contrary to the principle of non-maleficence, and provision of such interventions may cause clinicians significant moral distress. However, because the application of these policies involves taking choices out of the domain of shared decision-making, they face (...) important ethical and legal problems, including a recent challenge to their constitutionality. In light of these concerns, we suggest a re-conceptualization of informed non-dissent as an alternative approach in cases where the application of process-based policies is being considered. This clinician-directed communication model still preserves what is valuable in such policies and salvages professional integrity, while minimising ethical and legal challenges. (shrink)

In Brazil, the CNPq provides grants, funds and fellowships to productive scientists to support their investigations. They are ranked and categorized into four hierarchical levels ranging from PQ 1A to PQ 1D. Few studies, however, report and analyse scientific productivity in different sub-fields of Biomedical Sciences, e.g., Biochemistry, Pharmacology, Biophysics and Physiology. In fact, systematic comparisons of productivity among the PQ 1 categories within the above sub-fields are lacking in the literature. Here, the scientific productivity of 323 investigators receiving PQ (...) 1 fellowships in these sub-fields of BS was investigated. The Scopus database was used to compile the total number of articles, citations, h-index values and authorship positions in the most cited papers by researchers granted CNPq fellowships. We found that researchers from Pharmacology had the best performance for all of the parameters analysed, followed by those in Biochemistry. There was great variability in scientific productivity within the PQ 1A level in all of the sub-fields of BS, but not within the other levels. Analysis of the most cited papers of PQ 1 researchers in Pharmacology revealed that the citations of researchers in the 1C and 1D levels were associated with publications with their senior supervisors, whereas those in the 1B level were less connected with their supervisors in comparison to those in 1A. Taken together, these findings suggest that the scientific performance of PQ 1A researchers in BS is not homogenous. In our opinion, parameters such as the most cited papers without the involvement of Ph.D. and/or post-doctoral supervisors should be used to make decisions regarding any given researcher’s fellowship award level. The idea that natural selection acts on many levels—and not only at the level of organisms or individual genes—is increasingly accepted among biologists. However, it is not easy to reconcile this idea with the strictly “individualistic” conception of the evolutionary process that has always characterized Darwinian thought. Moreover, the individuality of some forms of life is a vague concept and therefore controversial. This is the case of Candidatus Magnetoglobus multicellularis, whose discovery immediately inspired the following question: Does the concept of (...) individuality have degrees? Alternatively, how far is this structure of prokaryotic cells from deserving to be called an organism? In this article, we propose a new conceptual scheme based on an idea of individuality that is not limited to organisms and that makes sense in terms of Darwinian evolution. In this conceptual scheme, selection at levels above that of the individual organism is interpreted as the evolutionary emergence of higher-level individuality. This proposal may serve as a basis on which to construct a promising hierarchical evolutionary theory. (shrink)

La forma sonata es una de las estructuras musicales más empleadas desde el siglo XVIII, tanto en obras para instrumento solista como en música de cámara, sinfónica e incluso en ópera. La disposición formal de este tipo de construcciones se basa en las relaciones establecidas entre las sensaciones sonoras de reposo, inestabi-lidad y tensión, generadas inicialmente en el discurso armónico. Sin embargo, estas relaciones se pueden situar también en los niveles melódico, rítmico y tímbrico. En este documento se presenta el (...) primer movi-miento del Cuarteto No 1 Op. 18 en Fa Mayor de Ludwig van Beethoven, compuesto en forma de sonata, como estructura basada en relaciones rítmicas. The therapeutic misconception has been seen as presenting an ethical problem because failure to distinguish the aims of research participation from those receiving ordinary treatment may seriously undermine the informed consent of research subjects. Hence, most theoretical and empirical work on the problems of the therapeutic misconception has been directed to evaluate whether, and to what degree, this confusion invalidates the consent of subjects. We argue here that this focus on the understanding component of informed consent, while important, might be (...) too narrow to capture the ethical complexity of the therapeutic misconception. We show that concerns about misplaced trust and exploitation of such trust are also relevant, and ought to be taken into account, when considering why the therapeutic misconception matters ethically. (Spanish) RESUMEN: La libertad absoluta postulada por Viktor Emil Frankl y Jean-Paul Sartre, la Shoah y la creencia en un dios omnipotente, bueno y justo parecen contradecirse. La pregunta por el sentido del sufrimiento de las víctimas del Holocausto (la verdadera catástrofe, el mayor crimen contra la humanidad), simbolizado por Auschwitz, y como punto de inflexión en la historia, es terriblemente dolorosa y parece no tener una respuesta filosófica ni teológica. A mi juicio, es importantísimo distinguir entre las víctimas inocentes (...) de la Shoah que perecieron y las víctimas inocentes que sufrieron un verdadero infierno y perdieron a sus seres queridos, pero que lograron sobrevivir. Ambas son víctimas, por supuesto, pero así como encontrarle un posible sentido al sufrimiento de las víctimas masacradas y gaseadas podría suponer un insulto a su sufrimiento y agonía –en especial, al horror que sufrieron los niños–, el horrible sufrimiento de los supervivientes pudo dar, tal vez, de alguna manera, un sentido a sus vidas después de la liberación de los campos de concentración y exterminio, ya fuera como voz, como protesta o como simple supervivencia. Frankl apuesta por un sentido último (que abraza el sentido del sufrimiento de las víctimas), y Sartre, aunque parezca no apostar por sentido alguno, volcó su vida al compromiso político después de la Segunda Guerra Mundial, y ello parece vislumbrar una minúscula pizca de sentido después de la barbarie. La filosofía de Frankl es un sí a la vida incluso en las situaciones más extremas, un grito casi nietzscheano que exalta el valor de la vida más allá de cualquier sufrimiento. Frankl, padre de la logoterapia y superviviente del Holocausto, abre una puerta a Dios al hablar de un dios inconsciente, una dimensión suprahumana y una fe incondicional, y define la religión como espiritualidad y como la búsqueda del hombre por el sentido último. Según Frankl, la libertad no se contradice con Dios, y la religión existe no a raíz de la barbarie, sino a pesar de la barbarie. El existencialismo sartreano es una filosofía de la libertad radical y de la responsabilidad. El hombre está condenado a ser libre. El ser humano es un ser en el que la existencia precede a la esencia. Somos totalmente responsables de lo que somos. Sartre afirma que la libertad humana es incompatible con Dios. En un mundo sin Dios, la moral la construyen los hombres, con sus propias decisiones y sus acciones, y la existencia y el sufrimiento de las víctimas no tienen sentido alguno. Sartre define al hombre como libertad, responsabilidad, angustia y contingencia. Frankl define al hombre como libertad, responsabilidad, espiritualidad y búsqueda de sentido. Con esta tesis me propongo entrar en la resbaladiza dimensión del dolor, la desesperación, el sentido y sinsentido del sufrimiento de las víctimas (teniendo presente los horrores de Auschwitz, que en teología y filosofía ha simbolizado desde la liberación de los campos la muerte de Dios y la muerte de la moral). Es verdad que no solo los hombres, mujeres y niños judíos fueron víctimas de la barbarie alemana, pero, como reza el mensaje de Elie Wiesel en la exposición permanente del Block 27 del Auschwitz-Birkeanu State Museum: "Not all victims were Jewish in this place, but all Jews were victims". La Shoah no es un episodio dentro de la Segunda Guerra Mundial, sino un punto de inflexión en la historia de la humanidad, y es una catástrofe que nos concierne a todos, hombres y mujeres judíos y no judíos, religiosos e irreligiosos, creyentes e increyentes, como seres libres, responsables y morales que somos –o que deberíamos ser. Muchas de las víctimas del Holocausto, en medio de la desesperación, entraron en las cámaras de gas orando, aferrándose a la esperanza de que ese final espeluznante no era un punto final. Con esta tesis no me propongo de ninguna manera responder a la eterna pregunta de si Dios existe o no, sino que propongo interpretar ese grito hacia Dios como un desesperado anhelo de esperanza. También me propongo encontrar una coherencia en las posturas de estos dos grandes pensadores para quienes la libertad y la responsabilidad definen al hombre: Frankl (quien apuesta por una dimensión suprahumana donde existe un sentido último en el que el sufrimiento de las víctimas tiene que tener algún sentido, aunque ese sentido sea completamente incomprensible en la dimensión humana) y Sartre (el existencialista ateo por excelencia, para quien el mundo, la existencia y el sufrimiento son absolutamente contingentes). En el primer capítulo expongo la logoterapia y el existencialismo sartreano: describo las tres dimensiones del hombre y las tres búsquedas de sentido propuestas por Frankl, y expongo las cinco consecuencias de "l'existence précède l'essence", centrándome en la libertad y la responsabilidad, y hablo del suicidio. El segundo capítulo está dedicado al dios inconsciente frankleano, la dimensión suprahumana, la búsqueda por el sentido último y la fe incondicional. En el tercer capítulo ilustro la libertad sin Dios sartreana, la ontología sartreana, el ateísmo sartreano y el humanismo sartreano, y hablo sobre la responsabilidad, la mauvaise foi, la contingencia, la situation y la angustia. El cuarto capítulo es necesariamente histórico (sin dejar de ser filosófico): me pregunto por la muerte de Dios después de Auschwitz, argumento y defiendo la unicidad del Holocausto (la Shoah es un punto de inflexión en la historia de la humanidad), describo las masacres antes de los campos de exterminio (Einsatzgruppen, Ordnungspolizei y Wehrmacht), el gigantesco complejo de Auschwitz (Stammlager, Auschwitz-Birkenau y Monowitz-Buna), reflexiono sobre Dios y el mal (centrándome en los niños de Auschwitz), describo los días de Frankl en Auschwitz, hablo de Dios como esperanza, de la inmortalidad y la escatología, de la crueldad de Dios, de la relación entre el cristianismo y el antisemitismo, del islam y el antisemitismo, critico el silencio de Dios, hablo de la muerte de Dios y del juicio contra Dios. En el quinto capítulo expongo la moral frankleana (una moral que atañe al hombre y no a Dios), basándome en su teoría del amor y en su única obra de teatro (Synchronisation in Binkerwald), y la moral sartreana (una moral que atañe a una humanidad sin Dios), recordando a Dostoyevsky, analizando la famosa cita de Garcin en Huis clos "L'enfer, c'est les Autres", criticando el marxismo de Sartre y cuestionando (con la mirada de Frankl y Sartre) el verso de Brecht "Erst kommt das Fressen, dann kommt die Moral"; al final del capítulo incluyo una reflexión propia y las críticas frankleana y sartreana sobre la impunidad de los verdugos y colaboradores después del Holocausto (con el permiso de Dios). The question of the meaning of the victims' suffering of the Holocaust (the true catastrophe, the biggest crime against humanity), simbolised by Auschwitz and as a turning point in History, is terribly painful and doesn't seem to have an answer. In my opinion, it's crucial to distinguish between the innocent victims of the Shoah who perished and the innocent victims who sufferend a real hell and lost their loved ones, but managed to survive. Both are victims, of course, but just as finding a possible meaning to the suffering of the massacred and gassed victims could result in an insult to their suffering and agony –especially to the horror that the children suffered– the gigantic suffering of the survivors could, maybe, somehow, give a meaning to their lives after the liberation of the concentration and extermination camps, either as a voice, as a protest, or as a simple survival. Frankl believes in an ultimate meaning (that embraces the meaning of the victims' suffering), and Sartre, even if it appears not to embrace any meaning, turned his life to political engagement after War World II, and that attitude seems to give a tiny glimpse of meaning after the barbarity. Frankl's philosophy says yes to life even in the most extreme situations, and it's a Nietzschean-like scream that exalts the value of life beyond any monstrous suffering. Frankl, the father of logotherapy and a Holocaust survivor, opens a door to God when he talks about an unconscious God, a supra-human dimension and an unconditional faith; he defines religion as spirituality and as man's search for ultimate meaning. According to Frankl, freedom is not contradictory with God, and religion exists not because of the barbarity but in spite of the barbarity. Sartrean existentialism is a philosophy of radical freedom and responsibility. Men are condemned to be free. We are beings where the existence precedes the essence. We are completely responsible of what we are. Sartre argues that human freedom is incompatible with God. In a godless world, morality is constructed by people, with their own choices and actions, and human existence and the suffering of the victims don't have any meaning. Sartre defines man as freedom, responsibility, Angst and contingency. Frankl defines man as freedom, responsibility, spirituality and search for meaning. With this dissertation I attempt to enter in the slippery dimension of the pain, despair, meaning and meaninglessness of the victims' suffering (having in mind the horrors of Auschwitz, that in theology and in philosophy have simbolised, since the liberation of the camps, the death of God and the death of morality). It's true that not only Jewish men, women and children were victims of the German barbarity, but, as Elie Wiesel's message from the permanent exhibition from Block 27 of the Auschwitz-Birkeanu State Museum reads: "Not all victims were Jewish in this place, but all Jews were victims". The Shoah is not an episode inside War World II, but a turning point in the history of humankind, and a catastrophe that embraces us all, Jewish and not not Jewish men and women, religious and not religious, believers and not believers, as the free, responsible and moral beings that we all are –or that we should be. A lot of the victims, in the midst of their desperation, entered into the gas chambers praying, holding to the hope that their horrifying end was not the ultimate end. With this dissertation I do not attempt to answer the eternal question of the existence of God, rather, I will try to interpret that scream to God as a longing for hope. I also intend to find a coherence between the thought of these two great thinkers for whom freedom and responsibilty define man: Frankl (who argues that there is a suprahuman dimension where an ultimate meaning exists and where the victims' suffering has to have a meaning, even if this meaning is completely incomprehensible in the human dimension) and Sartre (the atheist existentialist par excellence, for whom the world, human existence and suffering are absolutely contingent). In the first chapter I expose logotherapy and Sartrean existentialism: I describe the three dimensions of man, the three searches for meaning, the five consequences of "l'existence précède l'essence" and I speak about suicide. The second chapter delves into the unconscious God, the supra-human dimension, the ultimate meaning and the unconditional faith. In the third chapter I expose the freedom without God defended by Sartre, Sartre's ontology, Sartre's atheism, Sartre's humanism, and his ideas about responsibility, mauvaise foi, contingency, situation, and Angst. The fourth chapter is necessarily historical (while being philosophical too): I wonder about the death of God after Auschwitz, I argue and defend the uniqueness of the Holocaust (the Shoah is a turning point in the history of humankind), I describe the massacres before the extermination camps (Einsatzgruppen, Ordnungspolizei y Wehrmacht), the gigantic Auschwitz camp complex (Stammlager, Auschwitz-Birkenau y Monowitz-Buna), I reflect on God and evil (focusing on the children of Auschwitz), I describe Frankl's days in Auschwitz, I talk about God as hope, about immortality and escathology, I discuss God's cruelty, the relationship between Christianity and antisemitism and Islam and antisemitism, I question the silence of God, and I talk about the death of God and about the trial against God. In the fifth chapter I talk about the Franklean morality (a morality that concerns man and not God), on the basis of his love theory and his only work of theater (Synchronisation in Binkerwald), and the Sartrean morality (a morality that concerns a humanity without God), remembering Dostoyevsky, analysing Garcin's famous quote in Huis clos "L'enfer, c'est les Autres", crticizing Sartre's marxism and questioning (with Frankl's and Sartre's eyes) Brecht's verse "Erst kommt das Fressen, dann kommt die Moral"; at the end of the chapter I include my own reflection (and Frankl and Sartre's critique) about the impunity of the executioners and collaborators after the Holocaust (with God's permission). After the Conclusion, I add an Appendix about the lives of Frankl and Sartre, which helps understanding better their work. In this paper, we propose Kripke-style models for the logics of evidence and truth LETJ and LETF. These logics extend, respectively, Nelson’s logic N4 and the logic of first-degree entailment with a classicality operator ∘ that recovers classical logic for formulas in its scope. According to the intended interpretation here proposed, these models represent a database that receives information as time passes, and such information can be positive, negative, non-reliable, or reliable, while a formula ∘A means that the information about (...) A, either positive or negative, is reliable. This proposal is in line with the interpretation of N4 and FDE as information-based logics, but adds to the four scenarios expressed by them two new scenarios: reliable information for the truth and for the falsity of a given proposition. The eliminative view of gauge degrees of freedom—the view that they arise solely from descriptive redundancy and are therefore eliminable from the theory—is a lively topic of debate in the philosophy of physics. Recent work attempts to leverage properties of the QCD $$\theta _{\text {YM}}$$ θ YM -term to provide a novel argument against the eliminative view. The argument is based on the claim that the QCD $$\theta _{\text {YM}}$$ θ YM -term changes under “large” gauge transformations. Here we review (...) geometrical propositions about fiber bundles that unequivocally falsify these claims: the $$\theta _{\text {YM}}$$ θ YM -term encodes topological features of the fiber bundle used to represent gauge degrees of freedom, but it is fully gauge-invariant. Nonetheless, within the essentially classical viewpoint pursued here, the physical role of the $$\theta _{\text {YM}}$$ θ YM -term shows the physical importance of bundle topology (or superpositions thereof) and thus counts against (a naive) eliminativism. Este trabajo estudió la defensa del niño concebido aún no nato y el reconocimiento del no nacido en los casos que se trate de su bien en el ordenamiento jurídico venezolano. El objetivo general estuvo dirigido al examen del ordenamiento jurídico patrio en cuanto a las normas que salvaguardan la vida desde la concepción en el seno materno. Se trata pues de una investigación documental, en donde se analizó la doctrina nacional y foránea sobre la protección del no nacido, su (...) reconocimiento, además se tomó en cuenta lo establecido en el Catecismo de la Iglesia Católica y en el Compendio de la Doctrina Social de la Iglesia sobre el aborto y la defensa de la vida, también se analizaron las leyes nacionales que tratan sobre la materia objeto de estudio. Se concluyó que aunque el ordenamiento jurídico venezolano no expresa claramente la defensa de la vida desde el momento de su concepción, reconoce los derechos del no nacido cuando se trate de su bien; tomando esto en cuenta se hace un análisis extenso haciendo uso de la hermenéutica jurídica para determinar que la norma protege la vida del concebido puesto que el bien más preciado que tiene el hombre es el derecho a la vida. . Not all symmetries are on a par. For instance, within Newtonian mechanics, we seem to have a good grasp on the empirical significance of boosts, by applying it to subsystems. This is exemplified by the thought experiment known as Galileo’s ship: the inertial state of motion of a ship is immaterial to how events unfold in the cabin, but is registered in the values of relational quantities such as the distance and velocity of the ship relative to the shore. But (...) the significance of gauge symmetries seems less clear. For example, can gauge transformations in Yang-Mills theory—taken as mere descriptive redundancy—exhibit a similar relational empirical significance as the boosts of Galileo’s ship? This question has been debated in the last fifteen years in philosophy of physics. I will argue that the answer is ‘yes’, but only for a finite subset of gauge transformations, and under special conditions. Under those conditions, we can mathematically identify empirical significance with a failure of supervenience: the state of the Universe is not uniquely determined by the intrinsic state of its isolated subsystems. Empirical significance is therefore encoded in those relations between subsystems that stand apart from their intrinsic states. (shrink)

The return of language is linked with the disappearance of man. History is discontinuos. Foucault doubted the truths of each era as well as the timeless truths. In this article I present man’s journey in Foucault’s Les mots et les choses, showing the tension between language and the disappearance of man, I talk about historical discontinuity and the “jeux de vérité”, and I argue that Foucault considered himself, above all, a skeptical thinker. Local gauge theories are in a complicated relationship with boundaries. Whereas fixing the gauge can often shave off unwanted redundancies, the coupling of different bounded regions requires the use of gauge-variant elements. Therefore, coupling is inimical to gauge-fixing, as usually understood. This resistance to gauge-fixing has led some to declare the coupling of subsystems to be the \textit{raison d'\^etre} of gauge \cite{RovelliGauge2013}. Indeed, while gauge-fixing is entirely unproblematic for a single region without boundary, it introduces arbitrary boundary conditions on the (...) gauge degrees of freedom themselves---these conditions lack a physical interpretation when they are not functionals of the original fields. Such arbitrary boundary choices creep into the calculation of charges through Noether's second theorem, muddling the assignment of physical charges to local gauge symmetries. The confusion brewn by gauge at boundaries is well-known, and must be contended with both conceptually and technically. It may seem natural to replace the arbitrary boundary choice with new degrees of freedom, for using such a device we resolve some of these confusions while leaving no gauge-dependence on the computation of Noether charges \cite{DonnellyFreidel}. But, concretely, such boundary degrees of freedom are rather arbitrary---they have no relation to the original field-content of the field theory. How should we conceive of them? Here I will explicate the problems mentioned above and illustrate a possible resolution: in a recent series of papers \cite{GomesRiello2016, GomesRiello2018, GomesHopfRiello} the notion of a connection-form was put forward and implemented in the field-space of gauge theories. Using this tool, a modified version of symplectic geometry---here called `horizontal'---is possible. Independently of boundary conditions, this formalism bestows to each region a physically salient, relational notion of charge: the horizontal Noether charge. Meanwhile, as required, the connection-form mediates an irenic composition of regions, one compatible with the attribution of horizontal Noether charges to each region. Thes aims of this paper are to highlight the boundary issues in the treatment of gauge, and to discuss how gauge theory may be conceptually clarified in light of a resolution to these issues. O silêncio e a invisibilidade são as palavras que melhor representam a história da mulher no decorrer de muitos séculos. Desde a antiguidade, as mulheres foram impedidas de falar, e até nos dias atuais, infelizmente, pouco se valoriza o discurso feminino. Em diversas sociedades, o direito a expressar-se é severamente combatido, punido com rigor. A essas mulheres, vilipendiadas em seus direitos, resta um único espaço: o da subalternidade. Nesse contexto de subalternidade, habitando o espaço prisional marginal, fazer uso da palavra (...) e apropriar-se do direito à fala é um ato de coragem e de rebeldia. O presente artigo analisa o testemunho de uma mulher em situação de prisão que, até chegar ali, teve quase todos os seus direitos humanos profanados. A narrativa destaca suas experiências e traz à luz suas memórias e a maneira como dialoga com o passado. A partir da cela da prisão, a mulher produz o seu discurso, elabora o seu balbucio, que embora abafado, ultrapassa as grades e os altos muros. É através do poder de sua voz que ela reivindica o direito à fala, o direito de recontar-se, de falar de si. Neste artigo, analisamos, sob a perspectiva dos Estudos Culturais, a história narrada por VB1, uma mulher negra que cumpre pena em regime fechado. A partir desta análise, propomos uma reflexão sobre o espaço prisional, o direito à fala e o papel da memória nesse processo. Teremos como referências teóricas as identidades culturais em tempos de pós-modernidade com Stuart Hall, as reflexões sobre memória individual e coletiva de Maurice Halbwachs, estudos acerca da subalternidade com Hugo Achugar e Gayatri Spivak, espaço fronteiriço e memórias subalternas com Edgar Nolasco, reflexões sobre o papel da mulher propostas por Michele Perrot, entre outros. En este escrito se presentan algunos desarrollos de la teoría política de John Rawls ahondando en aquellas categorías que permitan contrastar aspectos de los planteamientos rawlsianos con spectos del pensamiento utilitarista clásico. El propósito es discernir qué tan grande es la deuda que tienen pensadores contemporáneos como Rawls con autores clásicos del siglo XIX tales como Bentham y Mill.

Este trabalho apresenta algumas considerações do pensador italiano Gianni Vattimo acerca da religião na idade contemporânea. O referido filósofo tem como base de suas reflexões a ideia de uma filosofia pós-moderna que se caracteriza pela desconstrução da metafísica da tradição moderna. Nesse sentido, o autor visualiza nas filosofias de Nietzsche e Heidegger a inauguração de uma nova orientação do pensamento ocidental, marcada por esse rompimento com as filosofias totalizantes e pela consideração do ser como resultado das circunstancias eventuais que compõem (...) a experiência existencial. A religião, por sua vez, não acompanhou tal movimento, mas conservou um pensamento marcado ainda pela estrutura da metafísica tradicional, por isso, não se encontra em condições de responder às atuais demandas deste mundo plural. O autor sinaliza para a necessidade da abdicação das estruturas dogmáticas e dos fundamentalismos da religião como meio para a abertura ao diálogo inter-religioso e intercultural. (shrink)

It is argued here that bioethicists might inadvertently be promoting genetic determinism: the idea that genes alone determine human traits and behaviours. Discussions about genetic testing are used to exemplify how they might be doing so. Quite often bioethicists use clinical cases to support particular moral obligations or rights as if these cases were representative of the kind of information we can acquire about human diseases through genetic testing, when they are not. On other occasions, the clinical cases are presented (...) in simplistic ways that portray genetic testing as yielding information more accurate than it actually is. It is concluded that, because of the problematic implications that the ideology of genetic determinism might have for individuals’ wellbeing and for our public policies, bioethicists should be careful to present these issues in ways that do not promote questionable ideas about the causal role of genes in human diseases and behaviours. Since communication and expression are central aspects of music performance it is important to develop a systematic pedagogy of teaching children and teenagers expressiveness. Although research has been growing in this area a comprehensive literature review that unifies the different approaches to teaching young musicians expressiveness has been lacking. Therefore, the aim of this article is to provide an overview of literature related to teaching and learning of expressiveness from music psychology and music education research in order to build a (...) new theoretical framework for teaching and learning expressive music performance in instrumental music lessons with children and teenagers. The article will start with a brief discussion of interpretation and expression in music performance, before providing an overview of studies that investigated teaching and learning of performance expression in instrumental music education with adults and children. On the foundation of this research a theoretical framework for dialogic teaching and learning of expressive music performance will be proposed and the rationale explained. Dialogic teaching can be useful for scaffolding young musicians’ learning of expressivity as open questions can stimulate thinking about the interpretation and may serve to connect musical ideas to the embodied experience of the learner. A “toolkit” for teaching and learning of expressiveness will be presented for practical application in music lessons. In addition, a theoretical model will be proposed to further our understanding of teaching and learning of expressive music performance as a multifaceted and interactive process that is embedded in the context of tutors’ and learners’ experiences and environment. Finally, implications of this framework and suggestions for future research will be discussed. (shrink)

While various definitions of moral distress have been proposed, some agreement exists that it results from illegitimate constraints in clinical practice affecting healthcare professionals’ moral agency. If we are to reduce moral distress, instruments measuring it should provide relevant information about such illegitimate constraints. Unfortunately, existing instruments fail to do so. We discuss here several shortcomings of major instruments in use: their inability to determine whether reports of moral distress involve an accurate assessment of the requisite clinical and logistical facts (...) in play, whether the distress in question is aptly characterized as moral, and whether the moral distress reported is an appropriate target of elimination. Such failures seriously limit the ability of empirical work on moral distress to foster appropriate change. (shrink)

After a brief introduction to issues that plague the realization of a theory of quantum gravity, I suggest that the main one concerns defining superpositions of causal structures. This leads me to a distinction between time and space, to a further degree than that present in the canonical approach to general relativity. With this distinction, one can make sense of superpositions as interference between alternative paths in the relational configuration space of the entire Universe. But the full use of relationalism (...) brings us to a timeless picture of Nature, as it does in the canonical approach. After a discussion of Parmenides and the Eleatics' rejection of time, I show that there is middle ground between their view of absolute timelessness and a view of physics taking place in timeless configuration space. In this middle ground, even though change does not fundamentally exist, the illusion of change can be recovered in a way not permitted by Parmenides. It is recovered through a particular density distribution over configuration space which gives rise to 'records'. Incidentally, this distribution seems to have the potential to dissolve further aspects of the measurement problem that can still be argued to haunt the application of decoherence to Many-Worlds quantum mechanics. I end with a discussion indicating that the conflict between the conclusions of this paper and our view of the continuity of the self may still intuitively bother us. Nonetheless, those conclusions should be no more challenging to our intuition than Derek Parfit's thought experiments on the subject. (shrink)

In this paper we examine some proposals to disprove the hypothesis that the interaction between mind and matter causes the collapse of the wave function, showing that such proposals are fundamentally flawed. We then describe a general experimental setup retaining the key features of the ones examined, and show that even a more general case is inadequate to disprove the mind-matter collapse hypothesis. Finally, we use our setup provided to argue that, under some reasonable assumptions about consciousness, such hypothesis is (...) unfalsifiable. (shrink)

Why is gauge symmetry so important in modern physics, given that one must eliminate it when interpreting what the theory represents? In this paper we discuss the sense in which gauge symmetry can be fruitfully applied to constrain the space of possible dynamical models in such a way that forces and charges are appropriately coupled. We review the most well-known application of this kind, known as the 'gauge argument' or 'gauge principle', discuss its difficulties, and then reconstruct the gauge argument (...) as a valid theorem in quantum theory. We then present what we take to be a better and more general gauge argument, based on Noether's second theorem in classical Lagrangian field theory, and argue that this provides a more appropriate framework for understanding how gauge symmetry helps to constrain the dynamics of physical theories. The lack of public support for climate change policies and refusals to vaccinate children are just two alarming illustrations of the impacts of dissent about scientific claims. Dissent can lead to confusion, false beliefs, and widespread public doubt about highly justified scientific evidence. Even more dangerously, it has begun to corrode the very authority of scientific consensus and knowledge. Deployed aggressively and to political ends, some dissent can intimidate scientists, stymie research, and lead both the public and policymakers to oppose (...) important public policies firmly rooted in science. -/- To criticize dissent is, however, a fraught exercise. Skepticism and fearless debate are key to the scientific process, making it both vital and incredibly difficult to characterize and identify dissent that is problematic in its approach and consequences. Indeed, as de Melo-Martín and Intemann show, the criteria commonly proposed as means of identifying inappropriate dissent are flawed and the strategies generally recommended to tackle such dissent are not only ineffective but could even make the situation worse. -/- The Fight Against Doubt proposes that progress on this front can best be achieved by enhancing the trustworthiness of the scientific community and by being more realistic about the limits of science when it comes to policymaking. It shows that a richer understanding of the context in which science operates is needed to disarm problematic dissent and those who deploy it. This, the authors argue, is the best way forward, rather than diagnosing the many instances of wrong-headed dissent. (shrink)

The argument from inductive risk has been embraced by many as a successful account of the role of values in science that challenges the value-free ideal. We argue that it is not obvious that the argument from inductive risk actually undermines the value-free ideal. This is because the inductive risk argument endorses an assumption held by proponents of the value-free ideal: that contextual values never play an appropriate role in determining evidence. This article aims to rethink the meaning of “nature” and the human in Plato, more specifically through some examples contained in the _Phaedrus_, a rare dialogue further away from the city. Phaedrus and Socrates leave Athens on a path outside the walls, past the Ilisus stream and the breeze of the woods, and end up sitting in the shadows of trees full of singing cicadas. What is the meaning of this scenario in the construction o the text? Is it possible (...) to learn from oak trees or insects? The philosophizing of this dialogue passes through the coolness of the shadows of the trees in the hot summer noon. This sensuous topography through the text reveals the writer Plato wary of the enveloping meaning of the living drama between Phaedrus and Socrates. The audience and participation of natural elements, trees and cicadas in the dialogue reveals an involvement of the discourse with the surrounding atmosphere, a special concern of Socrates in his palinode and in his final prayer to Pan. In this dialogue, more than distinct and removed from nature, we think the human being (and reason) immersed in it - in an attempt to integrate a mythological and dialogical search between river, rock, plants, animals, humans, gods and demigods. The image of an overly rationalist and humanist Plato finds in this text a perspective of an inspired writer, a hybrid poet and philosopher, with a mission to restore language and the city to animal and cosmic life. This text represents our first attempting to offer a Metaphysic model to interpret the late modernity (which emerges in the middle of the 18th century and goes along until the end of the IIWW) through the concept of Teleontology. Thus, Teleontology means the procedure of the spirit of the late modern age to shift its paradigms from ontology (an investigation about the being as being, in which existence means an attribute) to teleology, in which essence must be conquered and revealed (...) in the final of a progressive process. Instead of Being, Man became the main object of this investigation; the question of the being as being has given way as to an enlightened concept of being-man (never reached) as also to the task to achieve this in order to satisfy what reason designed to human species. However, as this project of achieving the concept of Being-Man advanced, its true nature became clear: a unilateral and arbitrary colonial expansion, which forced everyone to follow Teleontological paradigms. Teleontology can demonstrate that Greek-Christian metaphysics means a particular element (never universal) submitted to a specific culture and, in this case, expresses the structure of Eurocentric thought that became global by way of the expanding of capitalism/colonialism. Specifically, in this text, we propose to investigate: 1 - what is Teleontology; 2 - what are its objects; 3 - what are its origins. (shrink)

Philosophers of science, particularly those working on science and values, often talk about the need for science to be socially responsible. However, what this means is not clear. In this paper, we review the contributions of philosophers of science to the debate over socially responsible science and explore the dimensions that a fruitful account of socially responsible science should address. Our review shows that offering a comprehensive account is difficult. We contend that broad calls for socially responsible science that fail (...) to attend to relevant dimensions are not the solution, as they preclude meaningful changes to research institutions and practices. We conclude that narrower, more explicit accounts are more likely to lead to substantive transformation. (shrink)

We review three broadly geometrodynamical---and in part, Machian or relational---projects, from the perspective of spacetime functionalism. We show how all three are examples of functionalist reduction of the type that was advocated by D. Lewis, and nowadays goes by the label `the Canberra Plan’. The projects are: the recovery of geometrodynamics by Hojman et al. ; the programme of Schuller and collaborators to deduce a metric from the physics of matter fields; the deduction of the ADM Hamiltonian by Gomes and (...) Shyam. We end by drawing a positive corollary about shape dynamics: namely, it has a good rationale for the Hamiltonian it postulates. (shrink)

Although science is our most reliable producer of knowledge, it can also be used to create ignorance, unjustified doubt, and misinformation. In doing so, agnotological practices result not only in epistemic harms but also in social ones. A way to prevent or minimise such harms is to impede these ignorance-producing practices. In this paper, I explore various challenges to such a proposal. I first argue that reliably identifying agnotological practices in a way that permits the prevention of relevant harms is (...) more difficult than it might appear. I focus on an identifying criterion that many find apt for the task: bad faith motives. I then consider an objection—that reliable criteria are unnecessary to successfully address the concerns raised by agnotological strategies—and I show that it fails. I conclude by exploring other ways of conceptualising the problems attributed to agnotological practices. In particular, I challenge the focus on misinformation as the main problem of concern. A FUNÇÃO SOCIAL DA POSSE COMO PARÂMETRO PARA TRATAMENTO DOS CONFLITOS FUNDIÁRIOS URBANOS.

In this paper, I provide an extensive examination of the political theory of Thomas Hobbes in order to discuss its relevance to an understanding of contemporary issues and challenges faced by criminal law and criminal justice theory. I start by proposing that a critical analysis of Hobbes’s account of punishment reveals a paradox that not only is fundamental to understanding his model of political society, but also can offer important insights into the preventive turn experienced by advanced liberal legal systems. I then suggest that the main importance of an analysis of Hobbes’s theoretical framework lies in how it reveals an inextricable and problematic link between individual autonomy and political authority in the normative conception of the modern liberal state, grounded on the notion of insecurity. By exploring how legal scholars have recently engaged with aspects of this problematic in criminal law and punishment posed by Hobbes’s work, I argue that the paradox found in punishment is such that it both legitimates the criminal law and undermines its normative aspirations, particularly the possibility of securing individual liberty against the power of the liberal state.
